United Driving School LLC (www.uniteddrivingschoolwi.com) (“United Driving School,” “we,”“us,” or “our”) is a company that offers driver education courses and related services. The courses offered are informational and state-licensed, satisfying state laws for classroom driver education, to be used in obtaining a driver's license or meeting requirements mandated for traffic violations. By using the services provided by United Driving School, you are agreeing to be bound by the following terms and conditions (“Terms of Service”), in addition to the Site Terms of Use Agreement and Privacy Policy, which are expressly incorporated into these Terms of Service. In the event of any conflict between these Terms of Service and the Site Terms of Use Agreement or Privacy Policy, these Terms of Service will control.
In these Terms of Service, persons, legal guardians of persons, or entities that are enrolled in and/or receive services directly from United Driving School are referred to as “account holder”, “user”, “Customer”, “Student”, “You”, or “Your.” These terms also refer to a person who is currently enrolled in a service or course provided by United Driving Schoool.
United Driving School reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, are subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. You can review the most current version of the Terms of Service at any time at: https://www.uniteddrivingschoolwi.com/terms/service.
Violation of any of the Terms of Service may result in the termination of services provided to you by United Driving School.
You must be 13 years or older to use any service rendered via United Driving School. United Driving School does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use www.uniteddrivingschoolwi.com and purchase services only with permission of a parent or guardian.
You must be a human. Students enrolled via the website by “bots” or other automated methods are not permitted.
You must provide your full legal name, a valid email address, and any other information requested to complete the enrollment process form or other form submissions permitted via the www.unitedrivingschoolwi.com website.
Your use of www.unitedrivingschoolwi.com and our data collection practices are subject to our Privacy Policy.
The World Health Organization has declared the novel Coronavirus (COVID-19) a worldwide pandemic. Due to its capacity to transmit from person-to-person through respiratory droplets, the government has set recommendations, guidelines, and some prohibitions which United Driving School, LLC abides by.
By agreeing to these terms you acknowledge that there is a possibility that any participant in our driver education program is vulnerable to illness such as, but not limited to, Influenza, MRSA, or COVID-19 that may lead to severe illness, paralysis, or death.
All participants are required to wear facial coverings / masks for all classroom / behind-the-wheel activities.
United Driving School retains the right to re-schedule your classroom / behind-the-wheel sessions if it is determined that the student may have come into contact with someone diagnosed with or exposed to COVID-19. As we learn more information, we may update our terms / requirements based on CDC guidelines.
Visiting www.unitedrivingschoolwi.com or sending email messages to United Driving School and its employees constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email or on the Site, satisfy any legal requirement that such communications be in writing.
As a United Driving School student or legal guardian of a student, when purchasing a course that is licensed and certified to meet state requirements governing a given course, you certify by agreeing to these terms that you (or the student you are purchasing services on behalf of) are the minimum age required by that state to complete that course.
The student and account holder agrees that he or she will solely study and review the course material and complete all discussion questions and tests and no other person. If United Driving School, the course provider, determines that the student has purposely misrepresented himself or herself, has cheated, or otherwise in a manner provided false or misleading information, United Driving School will cancel the student's account and no refunds shall be given in any capacity. It is illegal to provide false information for state-licensed courses, meaning the student may also be prosecuted for perjury and possibly other criminal acts where punishable by law.
The student is given 90 days to complete the online class. After 90 days, the course will expire, and the student must pay a re-instatement fee of $30 to extend the course for 30 days.
By State law you must start your Behind-the-wheel sessions within 60 days from the date printed on your MV3001 form. Failure to do this may result in a revoked permit.
It is your responsibility to register your permit in our system so we can begin the scheduling process. You must register your permit in our system within 7 days of receiving it.
All students must finish their behind-the-wheel sessions within 6 months of receiving their permit. Your contract expires after 6 months from your permit issue date. An additional fee of $75 per remaining lesson will be applied in order to continue.
We will charge a fee of $30 if a student does not show up for the lesson or cancels a lesson within 24 hours. All cancellations must be done through your online scheduling account, NO PHONE messages will be honored.
You must arrive on time for all lessons. We maintain the right to cancel a lesson within 24 hours due to weather, vehicle, instructor, or health issues.
By state law, if 13 months pass after completing the course without the student taking behind-the-wheel sessions, the student must take a 10-hour classroom refresher course—a $200 fee will apply.
For ALL offered course packages: These terms constitute the entire agreement between the school and the customer or student, and no verbal statement or promises will be recognized.
Online Failure to Yield Package: Upon completion of this course, United Driving School will notify the DMV with proof of completion. The student must successfully complete the online course as well as the final test to receive proof of completion. Upon submission, the student should check his or her driving status and eligibility to reinstate operating privileges (if the student has been suspended) at wisconsindot.gov. All students must complete the entire course within 12 months or will be subject to additional fees.
United Driving School will NOT refund any payment or tuition (or part of payment or tuition) IF United Driving School is ready, willing, and able to fulfill its part of this agreement.
If you choose to stop accepting services provided by United Driving School, United Driving School is not obligated to provide further access to a provided online course, and may immediately discontinue access to any online course as administered via www.teachsafe.com (Teach Safe, LLC). You also acknowledge and agree that United Driving School may delete course status and related information from the Teach Safe online course service.
You acknowledge that required periodic or emergency maintenance of the United Driving School website (Site) may result in the Site being unavailable temporarily. Emergency maintenance may occur without warning. In addition, third-party services, such as e-mail transmission, payment processing, or web hosting, may experience an outage, causing the Site not to operate as expected, resulting in temporary loss of service through the Site. United Driving School will make every effort to notify students and parents of scheduled and unscheduled maintenance in cases where it may affect their service, but makes no warranties regarding the length of time the Site may be down.
Certain services made available via www.uniteddrivingschoolwi.com/United Driving School are delivered by third-party sites and organizations. By using any product, service, or functionality originating from the www.uniteddrivingschoolwi.com domain, you consent to United Driving School’s sharing of information and data with the third-party service provider. You also agree that these sites and organizations and their practices are not under the control of United Driving School, and that United Driving School is not responsible for the contents of any site or those provided by an organization, including without limitation to any link contained in a Linked Site, or any changes or updates to a Linked Site, or the third parties provided services.
United Driving School has partnered with Teach Safe (https://www.teachsafe.com) to help us build and offer course packages that include an online/web-based course that may be completed over the internet rather than our in-person, physical classrooms. When enrolling in an online course package through United Driving School, your enrollment information is automatically used to generate a student user account in the Teach Safe website as part of our package offering. Both companies may share data between them, with the exception of any payment-related information, but only so that they may contact you or send you information on services provided by them that may be of value or interest to you as the consumer. We strongly encourage you to review its Privacy Policy and Terms prior to enrollment in our online course packages.
You are granted a non-exclusive, non-transferable, revocable license to access and use www.uniteddrivingschoolwi.com strictly in accordance with these Terms of Service. You are granted access to a physical classroom as part of purchased classroom packages, such as a Hybrid package. Packages include material provided in class, such as text books, video, and audio presentations, and other provided services in accordance with these Terms of Service. As a condition of your use of the Site, provided services, and classrooms, you warrant to United Driving School that you will not use the Site, services, and related materials for any purpose that is unlawful or prohibited by these Terms of Service. You may not use the Site, services, and related materials in any manner which could damage, disable, overburden, or impair them or interfere with any other party’s use and enjoyment of the Site, services, and/or materials.
You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site or course materials. United Driving School content is not for resale. Your use of the Site, services, and materials does not entitle you to make any unauthorized use of any protected content. You shall not alter any proprietary rights or attribution notices in any content. You will use protected content solely for your use and will make no other use of the content without the express written permission of United Driving School and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of United Driving School or our licensors except as expressly authorized by these Terms of Service.
All services rendered are controlled, operated, and administered by United Driving School from our offices within the USA and not intended for international use at this time. You agree that you will not use the United Driving School Content accessed through www.uniteddrivingschoolwi.com or its online courses administered on its behalf via the www.teachsafe.com (Teach Safe, LLC) website in any country or in any manner prohibited by any applicable laws, restrictions, or regulations.
You agree to indemnify, defend, and hold harmless United Driving School, its officers, directors, employees, owners, affiliates, attorneys, accountants, agents, and third parties, from and against any claim, suit, demand, loss, liability, damage, action, or proceeding arising out of or relating to: (i) your breach of any provision of these Terms of Service, or (ii) your use of the Service in a manner that is illegal, violates applicable law, or is inconsistent with these Terms of Service.
In addition to all other waivers, disclaimers, and limitations in these Terms of Service, we will not be liable for:
The failure of United Driving School to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and United Driving School and govern your use of the Service, superseding any prior agreements between you and United Driving School (including, but not limited to, any prior versions of the Terms of Service).
In no event shall United Driving School’s liability to you exceed the amount you have paid to United Driving School during the 12 months preceding your notice to United Driving School of its alleged liability.
These Terms of Service are entered into in the State of Wisconsin in the United States of America and shall be governed by and construed in accordance with the laws of the State of Wisconsin, exclusive of its choice of law rules. Each party to these Terms of Service submits to the exclusive jurisdiction of the state and federal courts for Washington County, Wisconsin, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. In any action to enforce these Terms of Service, the prevailing party will be entitled to costs and reasonable attorney's fees.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and United Driving School because of these Terms of Service or use of the www.uniteddrivingschoolwi.com website.
If any part of these Terms of Service is determined to be invalid or unenforceable pursuant to applicable law, including the limitations on liability set forth above and the warranty disclaimers set forth in the incorporated Site Terms of Use, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified in these Terms of Service, these Terms of Service constitute the entire agreement between you and United Driving School; it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and United Driving School.
A printed version of these Terms of Service and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms of Service to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
